The Frazier Decision Its Impact on High Conflict Cases

Judge Kepros and Judge Cox will be speaking on the Iowa Supreme Court’s Frazier decision and the current status of legal custody issues in Iowa. A panel of family law attorneys and mediators will further discuss the Frazier decision and strategies for dealing with high-conflict cases. Other sessions related to high-conflict cases include the use of Parenting Coodinators, which is increasing in Iowa. There are two sessions on domestic abuse: 1) the impacts of domestic abuse on families after separation and 2) screening for domestic abuse so you can recognize and deal with covert tactics of abuse during mediation.

Impacts of Domestic Abuse on Families After Separation (9:00am – 10:00am)
Kirsten Faisal, State Trainer for the Iowa Coalition Against Domestic Violence, will present. Domestic abuse doesn’t end with separation, it typically gets worse. This workshop examines how abusive strategies continue during and after divorce, ongoing impacts on children and other family members, and why both parties want or don’t want to engage in mediation. We’ll look at why it’s so important for each professional engaging with a family to screen for domestic abuse, even if someone else has already done so, and talk about personal risks to attorneys, mediators, and court personnel from people who abuse their intimate partners.
Parenting Coordination (10:00am – 11:00am)
Christine Crilley will speak on Parenting Coordination and the pros and cons of its use; and how to use in Iowa since Iowa has not passed the National Act. Parenting Coordination is an alternative dispute resolution process that is non-confidential, child centered; whereby the Parenting Coordinator works with parents (usually high-conflict) toward a healthier co-parenting relationship, dispute resolution and decision making. The Parenting Coordinator first works to educate and mediate the parents in parental disputes; then by agreement or Court Order, the Parenting Coordinator will make the decision when the parents are unwilling or unable to do so. Use is increasing in Iowa / 6JD.

Domestic Abuse: Screening and Awareness of Tactics During Mediation (11:15am – 12:15pm)
Keeping the parties separate is all I need to do, right? If only it were that easy. Controlling tactics can be used by abusers in shuttle and virtual mediation right under your nose. Sometimes they will even be used against you. Screening for domestic abuse is your first line of response to enhance the safety and autonomy of both parties and create the best context for successful mediation. This workshop will give you the four key questions to ask in screening and the red flag (s to look for that indicate a high risk of potentially lethal violence. Kirsten Faisal and Annie Tucker.

The Iowa Supreme Court’s Frazier Decision and the Current Status of Legal Custody Issues in Iowa (1:00pm – 2:00pm)
Judge Cox and Judge Kepros will review the Iowa Supreme Court’s Frazier decision and the current status of legal custody issues in the State of Iowa. Judge Cox and Judge Kepros will also discuss attempts to work around the Frazier decision and what practitioners can do going forward regarding joint custody disputes and modification cases.
